Terms of Service (TOS), End User License Agreement (EULA)

1. The Agreement

1.1 This agreement (‘’Agreement ‘’) is a legally binding agreement (“EULA) between you (“User”) and CAMTASTIC LTD. (‘’CMT’’). Subject to permitted modifications and amendments as stipulated herein, these Terms Of Service (‘’TOS’’) constitute the conditions for purchasing, using, and opening an account for using CMT’s Services. Please read these TOS carefully before accessing or installing or using CMT in any other matter. By using CMT or consuming the Services it provides, you agree to these TOS. If you are not eligible of entering a binding agreement or if you do not agree to any of the TOS, or to any modifications thereto, you must exit and/or uninstall CMT from your device(s) and/or computer, and you should discontinue using and/or accessing CMT until such time you can enter a binding agreement and agree to all of the TOS and to any modifications thereto.

Modification of the Terms of Service

1.2 CMT reserves the right to modify, change or revise these TOS at its sole discretion. Any such modification or revision shall take effect upon posting, unless otherwise stated. Therefore, please check these TOS whenever you access or use CMT Services as a condition for the continued use of CMT. Note, that your continued access or use of the Services will constitute your acceptance of such changes or modifications. This Agreement and any modification thereto shall remain in full force and effect for as long as you access or use the Services and/or as long as you have an account with any Service provided under the CMT brand.


2. Definitions and Abbreviations:

CMT may refer to us as the Camtastic (Company), as providers of the CMT services, or to the CMT Services.

Users means any person and/or other legal entity using the CMT Services, including yourself.

User Content means any content, in whatever form, including live streaming, text, gestures, still or live images, streamed, or posted, or broadcasted, or uploaded on or by using the site or Services.

Broadcasting means using the CMT Site or Services in order to stream video or audio, post, display transmit, broadcast, upload, or otherwise distribute User Content.

Holograph means a broadcast hologram showing more than one broadcaster at the same time appearing to be interacting together at the same place or with same background, to the viewing users.

Holographing / Holographer means broadcasting within a hologram

The CMT Services or the Services: Any and all of the features, tools, software, applications and other services of any nature or scope made available on our Site.

The CMT Software or Application, Site or the Sites: camtastic.org, camatstic.me, camtastic.mobi, camtastik.com, camtastick.com, camtastic.co, holo-deck.net, myholodeck.com, myholodeck.net, liveeventsnetwork.com, vibra-gear.com, vibra-wear.com and other websites related to: Camtastic, camtastik, camtastick, cam-tastic, cam-tastik, cam-tastick.

CMT account: An account created by a user upon registering to the CMT Services. Including finances of CMT and account types with credits and debits.


3. Restrictions on the Content You are permitted to Broadcast on CMT

By creating an account, you agree to comply with CMT’s TOS. These terms restrict the kind of User Content you can Broadcast by yourself or as Holographer.

3.1 The CMT terms prohibit you from using CMT to perpetuate fraud, harass or threaten or bully individuals, distribute malware, and Broadcast content that is offensive, indecent, illegal, obscene, defamatory, libellous, racist, or encourages conduct that would be considered a criminal offence, gives rise to civil liability, violates any law, or is otherwise inappropriate. The definition of such prohibited content may vary from user to user, community to community and country to country. These TOS do not define what CMT considers to fall within the definitions of the prohibited content. However, we ask you to use discretion, based on common sense, and on legal and acceptable norms and etiquette, which consider the age and unique sensitivities of the users with whom you communicate on CMT, when Broadcasting on CMT. If your broadcast may offend some users views or beliefs or feelings, please ensure you mark your room as NSFW (not safe for work) or “’Offensive Content”’ and require any Users interested in viewing it to confirm that they are at least 18 years of age and agree to this type of content prior to entering your broadcast.

3.2 The CMT terms strictly prohibit you from Broadcasting any content for which you don’t own the copyrights or other IP rights, and among other means it may use, CMT may remove any content which violates the proprietary rights of others as soon as it becomes aware of such a violation, and may, at it’s sole discretion limit or delete accounts of users who don’t comply with this rule.

3.3 The CMT terms also prohibit you from Broadcasting any content which violates any person’s or other legal entity’s privacy, to the extent forbidden by any law applicable to you. We ask you to respect other Users privacy and abstain from disclosing any personal information about any other user, without their expressed permission. If you disclose any personal information of others, you will be automatically in violation of the CMT terms and CMT reserves the right to take any appropriate actions, including immediately, and without notice, limiting or deleting or terminating your account and restricting you from using or accessing CMT in the future.

3.4 Please note that although CMT regularly monitors and moderates broadcasts, these terms absolve CMT of any supervisory capacity to the extent legally possible. CMT cannot effectively monitor and supervisor the content Broadcasted by users, and will intervene with User Content Broadcasted by Users only in cases where it receives specific justified and verified complaints, and/or when it is legally bound to do so.


4. Age Policy and Registration

4.1 Age Policy CMT has invested much thought and effort in creating areas of use defined and designed for the safe and convenient use of users of different age groups, and has taken special care to ensure that areas restricted to minors are protected from access or use by adults. Therefore, (a) CMT may require you to identify yourself by video upon registering to, or accessing, or using certain areas of CMT, and (b) you agree to access and use only areas designed and defined for the use of the age group to which you belong. CMT shall implement a zero tolerance policy regarding any violation of this condition, and reserves the right to take any appropriate actions, including immediately, and without notice, limiting or deleting or terminating your account and restricting you from using or accessing CMT in the future, if you violate or infringe CMT’s Age Policy. In addition, CMT reserves the right to report relevant information to authorities

4.2 If you download, install and create an account on CMT you must be at least 13 years of age. If you are under 18 years of age, you must receive your parents or legal guardian’s permissions before creating an account on CMT, and by using the CMT Services you declare and represent that you have, in fact, received their permission after they have read these TOS, approved them, explained them to you, and assumed full liability and responsibility to supervise your use of CMT. Upon registration, you may be required to disclose whether you are over or under 18 years of age. CMT may verify the information concerning your age. Individuals between 13-18 years of age may only create a ‘’Teen Account’’. Individuals over 18 years of age may create a regular account. Note, that all Users will be restricted from using areas on the CMT software, application and Site, which are not intended for their age group. Also, you must be capable of forming a legally binding contract, under your country’s laws if you wish to use any fee-based Service. Your account is solely for your personal use or your immediate family, and, is not transferable. Accordingly, you shall not permit others to use your User name or your Account. Users or accounts terminated or limited for violating CMT’s Age Policy, users who have repeatedly violated the TOS, are not legible to register for an Account and are prohibited from accessing and/or using the Services.

4.3 NO ONE UNDER THE AGE OF THIRTEEN (13) IS PERMITTED TO USE CMT ON THEIR OWN; In order to ensure this, if a child under 13 has access to your device(s) do not save your password and make sure you log out of your account after using CMT. Note that CMT makes continuing efforts to identify minors so that these prohibitions are implemented. However, it is easy for children to deceive about their age and gain access to material which may be inappropriate and unintended for them. Therefore, we recommend that parents apply reasonable parental control by using commercially available parental control protections, such as device(s), hardware, software, and filtering services which can be used to block a child’s access to on-line services, and assist parents in supervising their children’s on-line activities

4.4 Registration ‘’Registration Based Services’’ are available to Users who have created a CMT Account by completing a registration application and registering a valid user name and password. You agree to provide true, accurate and complete information about yourself, and to maintain and update the information periodically in order to keep it true, accurate and complete at all times. You must have a valid email address in order to register a user name and password. In some cases, you may be able to register by using your phone number on its own. When registering your user name and password, you may not choose a user name which is identical, misleading, or similar to the user name of another person with the intention of impersonating that person, choose the user name of anyone else without their explicit permission, choose a user name that violates or infringes the proprietary rights or names of any person or entity, or choose a user name that CMT, at its sole discretion, considers inappropriate. You are solely responsible for the use, maintenance, and protection of your user name and password. You may change your password periodically through ‘’My Account’’. You agree to notify CMT of any unauthorized use of your user name or any other breach of security, and to ensure that you log out from your Account at the end of each session. You must log-in to your Account at least once a week to remain in active status in groups, and, at least once every 15 days to maintain your badges, ratings and other community-related status. CMT may, without notification, terminate and delete your Account if you have not logged into it for a period of 90 days.


5. Terms and Termination

This Agreement and these TOS will remain effective and binding until terminated by either party. (a) You may terminate this Agreement at any time by closing your account(s) for all of the Services which you use through ‘’My Account’’, and discontinuing access to the Services. (b) CMT may terminate this Agreement without further obligation or liability to you if you have violated or infringed any provision of the TOS, or if we reasonably believe that you have done so, or in order to comply with the instructions of any competent court or law enforcement agency; CMT may also terminate this Agreement if providing the Services to you is no longer commercially viable. CMT reserves the right to terminate an Account without notice, at any time, for any reason, at its sole discretion. (c) In the event your account is terminated, CMT may, without notification, delete Your Content, and you will need to re-register for an account and obtain a new user name to gain access to any registration based Services. CMT will not be responsible for any losses, damages, claims and actions of any kind, either directly or indirectly related to or arising from the restriction, suspension, or termination of your account, access to the Services, or the deletion of Your Content.


6. Illegal and improper use

CMT has made many efforts to provide its Users with a safe and enjoyable experience, and will not tolerate activities which threaten/affects user safety and enjoyment and/or illegal activity. Without limiting any additional rights and remedies afforded herein, CMT may, at its sole discretion, and with no notice or warning, terminate and/or delete and/or suspend and/or limit your account and/or permanently limit your IP address from accessing the CMT Services if your CMT account is used to engage in any of the following strictly prohibited activities: (a) exploiting minors in any way including but not limited to posting or requesting personal or other information from a minor under the age of 18; or, (b) creating and distributing child pornography; or (c) Broadcasting or requesting explicit sexual consent in non-adult area; or, (d) using offensive or obscene or racist content in any form and of any nature; or, (e) illegal activity of any nature and in any form; or, (f) harassing or threatening or intimidating or bullying, or blackmailing other CMT Users; or, (g) violating or Infringing any other person’s intellectual proprietary or rights, including but not limited to patents, copyrights, trademarks, trade names, music, photos, videos, artwork, etc.; or. (g) impersonating another person; or, (h) impersonating or representing CMT; or, (i) attempting to fraudulently get another User’s password or account information; or, (j) Cyber-bullying and Cyber-stalking. CMT emphasizes that in addition to having your account terminated and your IP address permanently barred, you may also be criminally prosecuted for any illegal activity. Please note that when you use the CMT Services, CMT preserves information that personally identifies you as well as your activities, according to its Privacy Policy. This information may be provided to law enforcement agencies investigating criminal activity that has occurred using the CMT Services, and is sufficient information for law enforcement agencies to identify and locate you.


7. License to CMT Services, and disclaimer

(a) as long as you fully comply with this agreement and the TOS, CMT grants you a limited revocable, non-transferable, non-assignable, non-sub-licensable, and non-exclusive right and license to access and use the CMT Services as set forth in these TOS, for your personal use. You may not (nor may you permit anyone else to) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of any software or application or web site (or any part thereof) made available to you by CMT. (b) As long as you fully comply with this agreement and the TOS, CMT grants you a limited, revocable, non-transferable, non-assignable, non-sub-licensable, and non-exclusive right and license to access User Content for your information and personal use solely as intended through the provided functionality or the CMT Services. Unless expressly authorized by CMT in writing, you may not (nor may you permit anyone else to) copy or download any User Content unless the Service you are accessing provides the means to copy or download that content. (c) CMT has no control over User Content and does not guaranty the quality, accuracy, truthfulness, reliability, safety or legality of User Content. You acknowledge that CMT is an interactive online service provider, providing the Services to users for the purpose of communicating with other users and publishing User Content. You agree that CMT is not responsible for User Content or the actions or inactions of users.


8. Grant of License to Your Content

8.1 You represent and warrant that you own the rights to and/or are authorized to Broadcast any and all of the User Content which you Broadcast using the CMT Services. You retain ownership of all right, title, and interest in Your Content. However, by using the CMT Services, you grant CMT a license to use, distribute and exploit Your Content. More specifically, by Broadcasting your Content on or through the CMT Services, you are granting CMT the non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable and transferable right and license to use, reproduce display, publish, perform, distribute, transmit, broadcast, modify, adapt, prepare derivative works of, promote and otherwise exploit Your Content in any form, medium, device, technology, now known or later developed, and through any media channel, for any purpose. This includes, without limitation, the right to (i) make Your Content available to others on or through the CMT website, (ii) make Your Content available to others on third-party websites, and (iii) insert or otherwise place advertisements of any kind promoting CMT and its services within or around Your Content. You understand and agree that you will not be compensated in any way for Your Content, its distribution or exploitation under this agreement. (b). In addition to the rights, licenses and privileges granted above, you agree that CMT may use and refer to your trademarks, service marks, trade names, image, character, logos, domain names and other distinctive brand features or identification in marketing materials, presentations, customer lists, website materials, and other media now known or later developed in connection with the marketing, advertising and promotion of CMT and the Services without compensation or further obligation to you. (c). CMT is under no obligation to delete or ask third parties (including other users) to delete Your Content. Even if you remove Your Content, or your account is terminated (by you or by CMT), Your Content may continue to appear and be used indefinitely once it is broadcasted through the CMT Services

8.2 Notwithstanding, note that CMT does not record or keep records of live video or audio streams broadcasted on the Site. Should you wish to make your content available to other users, you may record your own broadcast on your device and explicitly upload it to your CMT profile for others to view for free or for a fee you may specify


9 Billing and Charges for Fee-Based Services

9.1 Billing. CMT may charge your CMT Account all amounts due at the rates and prices you agreed to, for any fee-based service, such as monthly or annual subscriptions or plans you may opt-in. You are solely responsible to ensure there is sufficient balance in your CMT account to execute transactions. You agree that in the event CMT is unable to collect the amount owed from your CMT Account, CMT may, without limiting its rights, terminate your CMT account, or cancel the related Service at CMT’s sole discretion.

9.2 Automatic Renewal. Any subscription to a fee-based Service will continue indefinitely until cancelled by you. After your initial subscription period, and after any subsequent renewal period, your subscription will continue for an additional equivalent period at the then current price. By subscribing to a fee-based Service, You are solely responsible to ensure there is sufficient balance in your CMT Account to execute automatic renewals. You agree that in the event your CMT Account does not have sufficient balance for executing an automatic renewal transaction, you authorize CMT to charge your preferred payment method (such as credit card or bank account) through any payment processors (such as Credit Card, PayPal, Skrill, xsolla, etc.) at the time of subscribing or renewal to the Service and again at the beginning of any subsequent subscription period. In the event CMT does not receive your payment from the processor, you agree that CMT may terminate or suspend your subscription and continue to charge your preferred payment method until payment is received.

9.3 Automatic exchange and conversion. You authorize CMT to automatically exchange and/or convert any CMT tender value (such as CMT coins and the like) in order to enable the execution of any transaction automatic renewal.

9.4 Free Trials. Any free trial promotion that provides access to a fee-based service can only be used during the specified trial period. In order to avoid being charged a subscription fee, you must cancel your subscription before the end of the trial period. Use of a free trial multiple times for the same user on the same type of trial is strictly prohibited and is considered a violation of the TOS, which may result in the termination and/or deletion of the CMT Account.

9.5 Promotion codes. Any promotion code that provides access to a fee-based service can only be used once. Use of Promo codes multiple times for a user is strictly prohibited and is considered a violation of the TOS, which may result in the termination and/or deletion of the CMT Account.

9.6 Cancellation/Termination. If you want to cancel your subscription to a fee-based service, log in to your CMT account, and cancel your subscription within ‘’My Account’’ (Deleted email support).

9.7 Refund Policy. All sales are final. No refunds will be given except in our sole and absolute discretion. If you terminate your CMT account or cancel your subscription to a fee-based service, you will not be eligible for a prorated refund of any portion of any subscription fee or other fee paid. However, you may continue to use your subscriptions after cancellation until the end of your current subscription term, and your subscription will not be renewed. Additionally, you will not be entitled to any refund of unused subscription fees if you violate any TOS and CMT terminates your account. Notwithstanding, if you register for the CMT fee based Services in Israel, The Israeli law permits you to cancel your subscription within 14 days of purchase, provided that you have not used any portion of the Services and, the service was provided by CMT or another user from Israel. Permitted CMT cancellations are refunded excluding any applicable transfer charges or currency exchange fees.


10 CMT coins and Virtual Goods

10.1 CMT coins and Tenders. CMT coins and tenders (coins and tenders interchangeably herein), are virtual property owned by CMT, and distributed to Users for a price, or in exchange for services rendered by Users. Users may use CMT Coins in order to make transactions with other Users, or with CMT via the CMT Services and Site. Only CMT can sell CMT Coins. When you purchase CMT Coins from price set by CMT, you are purchasing a limited license to use virtual property owned by CMT at a price set by CMT and subject to change without notice to you. More specifically, when you purchase CMT Coins, CMT grants you a limited, revocable, transferable license to use the CMT coins in conjunction with the Services, subject to the terms of this Agreement. CMT coins can be used to purchase services and goods.

10.2 CMT Tenders and exchange. CMT offers several tender types of value, such as coins, diamonds, sticks, stones and the like. Each tender type is used for a specific transaction within CMT. You may exchange between CMT tender types based on your needs at any time using ‘’My Vault’’, Note, the vault also contains non-value and non-exchangeable items such as badges, shields, spells and the like. Only CMT tender types can be exchanged.

10.3 Virtual Goods. Virtual Goods are virtual items that you may purchase or otherwise acquire from CMT in exchange for CMT Coins. Virtual Goods can be traded and exchanged as provided by the functionality of the Services.

10.4 Real goods. Real goods are items that you may purchase or send to another User and can be acquired from CMT or another CMT User in exchange for CMT Coins. Virtual Goods can be traded and exchanged as provided by the functionality of the Services.

10.5 Wish-lists. Every user can maintain wish-lists for both Virtual goods and Real goods. Any user can request or sent any other user to send or receive the Virtual good or Real goods.

10.6 Exchanging. Every user can exchange with another user Virtual goods. CMT takes a percentage of coins from the exchange value for processing.

10.7 Limitations. Other than the rights granted in Sections 10.1 and 10.2 above, you have no right or title in or to the CMT Coins you purchase or Virtual Goods you acquire.

10.8 Cash-out value, Certain CMT Tenders and virtual goods bear a cash-out value. All verified Users over the age of 18 can cash-out tenders and virtual goods for cash value and request to withdraw the funds through the software or application or through support@camtastic.org. Verified CMT Broadcasters within the Teen Zone may collect virtual goods and tenders, and cash-out once they have turned 15, or higher if your country minimum age of work is over 15 (the higher of the two options). Note, as cash-out value is only calculated for verified users and cash-out value is reset in the event User status is no longer verified, you are solely responsible for becoming verified and maintaining the verified status.

10.9 Withdrawing funds. Eligible Users can request to withdraw funds from CMT once per month through ‘’My Account’’. The option to withdraw the funds is automatically available, providing the User is in good standings and the minimum withdraw criteria is met. Withdraw requests are generally processed within ten (10) business days, but may take up to thirty (30) business days.

10.10 CMT commissions. Users may transfer CMT tenders to other Users, or charge for viewing a Profile or entering a Room (Deck). CMT charges a commission for the above transactions and vary depending on several factors. Commissions are always deducted from the amount transferred or value of the gift gifted. Commission charges are clearly displayed for each transaction by the initiating User, either by the User requesting to receive, or by the User.

10.11 DISCLAIMER. CMT HAS THE ABSOLUTE RIGHT TO MANAGE, REGULATE, CONTROL, MODIFY AND/OR ELIMINATE CMT COINS AND/OR VIRTUAL GOODS AND/OR COMMISSIONS AS IT SEES FIT IN ITS SOLE DISCRETION AND CMT SHALL HAVE NO LIABILITY TO YOU OR ANYONE FOR THE EXERCISE OF SUCH RIGHTS. CMT COINS AND VIRTUAL GOODS ARE SOLD ‘’AS IS’’ WITH NO WARRANTIES. CMT COINS HAVE A CASH VALUE, AND MAY BE REDEEMED FOR MONETARY VALUE FROM CMT. ALL CMT COINS HELD BY YOU SHALL BE FORFEITED IF YOUR USER ACCOUNT ASSOCIATED WITH THE CMT COIN TERMINATED FOR ANY REASON, IN CMT’S SOLE AND ABSOLUTE DISCRETION, OR IF CMT DISCONTINUES PROVIDING SERVICES UTILIZING CMT COINS AND VIRTUAL GOODS.


11 User Ads

11.1 User Ads is a fee-based premium service that provides the ability to promote a CMT User profile, show, or event to the CMT community through the use of banner or semi-transparent graphics or video. User Ads appear from time to time in CMT broadcast Decks, several CMT screens and web pages, displaying streaming ad units to viewer. The viewer has the option to click on the ad to visit your CMT Profile Page or close the ad. Depending on your Ad setup, the click opens your profile or Deck to the viewer.

11.2 You must have an Account with verified Status, in good standings and be logged in to submit an order for a User Ad. You can set the Ad options in the ‘’Promotion’’ section of your Deck prior to your submission. The charge for the Ad is calculated based on the options you select, and is clearly displayed prior to your transaction authorization.

11.3 CMT reserves the right to review, reject, limit, stop or delete any Ad for any reason, without prior notification or warning at its sole discretion.

11.4 Depending on your Ad campaign type, Running Ads are charged to your CMT Account on an hourly basis, daily basis or one-time charge. There are no charges for paused or stopped Ads. You may manage your Ads by stopping, pausing or resuming at any time. Upon a Daily-type Ad submission, or resuming a paused Daily type Ad, your CMT account will be charged on an hourly basis until the next daily billing cycle at midnight GMT.

11.5 In the event there are insufficient funds in your CMT Account, your Ad campaign will be paused and will automatically resume upon replenishing your CMT Account. It is your sole responsibility to stop the Ad campaign.

11.6 Any credit for unused portions of daily type Ads are applied to your account upon stopping the Ad, where the credit is calculated on unused hours. There is no credit or refund of any type for any one-time or hourly type Ads.

11.7 When serving your ad, we do our best to deliver your ad based on the Ad options you have selected. Although we cannot guarantee in every instance that your ad will reach its intended target, and we do not guarantee the activity that your ad will receive, such as the number of clicks or actions or views or entries to your broadcast(deck) you will get.


12 CMT Trademarks

12.1 CMT trademarks, logos, images, service marks, trade names and other distinctive branding features affixed or contained within the Services (‘’CMT Marks’’) are the trademarks of CMT and may not be used without CMT’s express written permission. Unless otherwise provided for in writing, CMT does not grant you a license under any intellectual property rights to the CMT Marks. Other trademarks, logos and trade names that may appear on or within the Services are the property of the respective owners.

12.2 You agree not to remove, obscure, or alter CMT Marks (including copyright and trademark notices) which may be contained within the Service, and not to create or publish, any similar or misleading marks which could cause others to mistakenly associate your mark with CMT marks.

12.3 Selected broadcasts/decks include the ability to take a photo of the stream. You agree not to record or screen capture any broadcast or deck, or User Broadcast containing CMT marks, without the prior written consent of CMT. CMT, at its sole discretion, reserves the right to limit or delete a User Account without prior notification or warning if it has reason to believe a User is recording or capturing a screen with CMT.


13 Content Restriction

13.1 You are solely responsible for all your broadcasted content under your account, in any form or nature, as well as any communication with other Users via the CMT Services.

13.2 You may not Broadcast or post, whether publicly or privately, any material that: (a) is false, misleading, deceptive, deceitful; or, (b). employs misleading email addresses or forged headers or otherwise manipulated identifiers in order to disguise the origin of the content posted; or, (c). contains viruses, Trojan horses, worms, time bombs, bots, scripts or any other harmful programs; or, (d). harasses, bullies, threatens, or abuses another person; or (e). any graphics or comments or streaming of racism or Nazism, is libellous, defamatory, invasive of privacy or publicity rights, or (f) vulgar, obscene, profane, indecent or otherwise objectionable; or, (g). violates any applicable law restricting the export or import of data, software, or any other content, or encourages conduct that would constitute a criminal offence; or, h). gives rise to civil liability; or (i). advertises any illegal service of the sale of any items the sale of which is prohibited or restricted by any applicable law; or (j) Otherwise violates any applicable local, state, national, foreign or international law or regulation.


14 Prohibited Uses of the Services

You may not use the Services in any manner not permitted by these Terms of Service, or for activities that violate any law, statute, ordinance or regulation. In addition, without limitation, you agree that you will not do any of the following while using the Services; (a). send unsolicited communication (including messages or email), including, without limitation, promotions, or advertisements for products or services or web sites or links; or, (b) collect or record or store personal information or data (including broadcast streaming, profile information) about other users without their explicit permission; or (c). impersonate or misrepresent your affiliation with any person or entity; or (d). access content or data not intended for you, or log onto a server or account that you are not authorized to access; or (e). circumvent, disable or otherwise interfere with security related features of the CMT Services or features that prevent or restrict use of copying of Used Content; or (f). attempt to probe, scan, or test the vulnerability of the CMT Services or to breach security of authentication measures, or features that prevent and restrict the use or copying of User Content without their proper authorization; or, (g). interfere or attempt to interfere with service to any user, host, server, or network, including, without limitation, by means of submitting a virus, overloading, ‘’flooding’’, ‘’pinging’’, ‘’spamming’’, ‘’mail bombing’’, or ‘’crashing’’ or (h) attempt to modify, reverse engineer, decompile, disassemble, or otherwise reduce or attempt to reduce to a human-perceivable form any of the source code used by CMT in providing the Services; or (i). use the Services in any manner that could damage, disable, overburden, impair or otherwise interfere with or disrupt the CMT Services, or any network or networks connected to the Services; or (j) Encourage or instruct any other individual or group to do any of the foregoing.

The CMT Services are not designed or licensed for use in hazardous environments requiring fail-safe controls, including without limitation operation of nuclear facilities, aircraft, navigation or communication systems, air traffic control, and life support or weapons systems, and such use is strictly prohibited. In addition, CMT services are not to be used for any time-critical, time sensitive, time-dependent, mission-critical, target-critical, real-time related operations. Any use in such requirements constitute a violation of the TOS.


15 Compliance with Intellectual Property Laws

Your use of the CMT Services is at all times governed by and subject to laws regarding copyright ownership and use of intellectual property. When using the CMT Services, you agree (a) to obey the law and to respect the intellectual property rights of others; (b) not to upload, download, display, perform, transmit, or otherwise distribute any material in violation of any third party’s copyrights, trademarks, or other intellectual property or proprietary rights; and (c) to abide by laws regarding copyright ownership and use of intellectual property, and you shall be solely responsible for any infringement of third party rights caused by any material you provide or transmit, or that is provided or transmitted using your user name. The burden of proving that any material does not violate any laws or third party rights rests solely with you.


16 Alleged Violations of the Terms of Service

To ensure that CMT provides a high quality experience for you and for other users of the Services, you agree that CMT may access your account(s) and records, and monitors your activities to investigate complaints or allegations of abuse, infringement of third party rights, or other unauthorized uses of the Services. CMT does not intend to disclose the existence or occurrence of such an investigation unless required by law, but CMT reserves the right to terminate your account(s) and/or your access to the Services, and to delete all of Your Content posted therein, with or without prior notice to you, and without liability to you, if CMT believes that you have violated any of these TOS, furnished CMT with false or misleading information, or interfered with the use of the Services.


17 No Duty to Monitor Content

CMT, in its sole discretion shall have the right (but not the duty) to monitor the Content Broadcasted on or through the CMT Services including, without limitation, the content of any communication that occurs on or through the instant message service and the internal email service, whether or not CMT is the intended recipient of the message or email. CMT reserves the right to remove Content that, in its sole judgement, does not meet its standards or does not comply with this Agreement, or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of others, but CMT is not responsible for any failure or delay in removing such content.


18 Reporting to Law Enforcement

The Services are intended for use by a general audience including minors and children as young as 13 years of age. Sexually explicit material is strictly prohibited. The traffic data and personal information of users whose account is associated with sexually explicit material may be reported to law enforcement authorities for prosecution under applicable criminal laws as follows: (a) Child Pornography. CMT reports the facts and circumstances sexually explicit material and other criminal offences involving children under the age of 18 which appears on the CMT Services. This includes, but is not limited to, the posting and/or broadcasting of sexually explicit material, (including without limitation, photos, videos, and live streaming) depicting children who appear to be under the age of 18 and, (b). Other types of abuse. Other violations of these Terms of Service that may compromise the safety of our members may be reported to local, national, or international law enforcement agencies in cooperation with the Virtual Global Taskforce.


19 Copyright Infringement

CMT may suspend or terminate and delete any User Account that is found to have been used to infringe on the rights of CMT, or of a third party, or otherwise violated any intellectual property laws or regulations. CMT’s policy is to investigate any allegations brought to its attention. If you have any evidence, know, or have a good-faith belief that your rights have been violated and you want CMT to delete, edit, or disable the material in question, you must provide us with the following information: (a). Identification of the copyrighted work claimed to have been infringed; and (b). Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material such as the URL or other specific location; and (c). Information reasonably sufficient to permit us to contact you, such as an address, telephone number, or e-mail address; and (d). A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (e). A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. and (f). The physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;

If you have been notified by CMT that Your Content has been removed (or access to it was disabled) in response to a notification of infringement, and you believe that Your Content is not infringing, or that you are using Your Content in a manner authorized by the copyright owner, the copyright owner’s agent, or pursuant to the law, you may send a counter-notice containing the following information to the Copyright Agent: (a). Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled; and (b). A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and (c). Your name, address, telephone number, and e-mail address; and (d). Your physical or electronic signature.


If a counter-notice is received by CMT, it may send a copy of the counter-notice to the original complaining party informing that person that CMT may replace the removed content or cease disabling it within 10 business days. Unless the copyright owner files an action seeking a court order against you or CMT, the removed content may be replaced, or access to it restored, within a commercially reasonable time.


20 TRANSACTIONS BETWEEN USERS, USER DISPUTES AND RELEASE

20.1 Disclaimer Related to Transactions Between Users. CMT is not a party to the transactions between users of the services, including, without limitation, with respect to the sale or purchase of goods or subscriptions to record content, nor is CMT acting as an agent of sale. CMT disclaims any responsibility for or liability related to such transactions, and any questions, complaints or claims related to a transaction with another user of the services should be directed to the appropriate user.

20.2 Responsibility for Resolving User Disputes. You acknowledge and agree that you are solely responsible for resolving any disputes between you and other users of the services including without limitation, disputes concerning transactions with other users. CMT reserves the right but has no obligation to monitor or resolve disputes between users of the services at its own discretion.

20.3 CMT holds any transactions related to tickets to online events “as escrow” until the event, whereby any user may roll-back (cancel) the transaction if the event did not start within 3 hours of the scheduled start time, including a change of the event’s date and/or time).

20.4 RELEASE FROM LIABILITY. YOU HEREBY RELEASE CMT, ITS PARENT COMPANY, AND THEIR AFFILIATES, OFFICERS, SHAREHOLDERS, OWNERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.

20.5 CMT is constantly developing its capabilities in systems and processes to fight scams. You may flag any other user for “transaction dispute”. CMT automatically monitors and reports flagging. In the case of verifiable proof of repeat abuse, CMT will make “best-efforts” to refund the complaining buyers with the highest possible refund to the best extent possible based on the seller’s account balance. CMT reserves the right to share seller information with authorities where there is sufficient evidence of a scam.


21 Advertisers, Other Businesses, and Links to Other Sites

The Services may provide links redirecting you to the websites of third-party merchants, and other third-parties. These links are provided solely as a convenience to you, and do not constitute an endorsement by CMT of the content of such third-party sites nor of the business practices of such other business, entities or individuals. CMT is not responsible for examining or evaluating, and does not warrant or claim responsibility for in any way, the products, services, offerings or business practices of any of these businesses, entities or individuals or the content of their websites. Likewise, CMT is not responsible for examining or evaluating, and does not claim responsibility for in any way, the products, services, or offerings of sites framed within a website operated by CMT, and does not make any representations regarding the business practices of any of these third-parties or the content of their websites. Your use of third-party websites is at your own risk and subject to the terms and conditions of use for such sites. You should carefully review their privacy statements and other conditions of use.


22 DISCLAIMER OF WARRANTIES

CMT CANNOT GUARANTEE CONTINUOUS OR SECURE ACCESS TO THE SERVICES WHICH MAY BE INTERFERED WITH BY NUMEROUS FACTORS OUTSIDE OF OUR CONTROL. ACCORDINGLY, TO THE EXTENT LEGALLY PERMITTED, CMT HEREBY DISCLAIMS ALL WARRANTIES. CMT IS MAKING THE SERVICES AVAILABLE ‘’AS IS,” ‘’WITH ALL FAULTS’’ ON AN ‘’AS AVAILABLE’’ BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CMT, EXPRESSLY DISCLAIMS AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. YOU ASSUME THE RISK OF ANY AND ALL DAMAGE OR LOSS FROM USE OF, OR INABILITY TO USE, THE SERVICES. ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE SERVICES IS ACCESSED AT YOUR OWN RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL. CMT DOES NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS IN THE SERVICES WILL BE CORRECTED.


23 LIMITED LIABILITY

CMT’S LIABILITY TO YOU IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL CMT, AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS BE LIABLE TO YOUR OR ANY THIRD PARTY FOR DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, OR LOST DATA, REGARDLESS OF THE FORESEEABILITY OF THOSE DAMAGES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES OR ANY OTHER MATERIALS OR SERVICES PROVIDED TO YOU. THIS LIMITATION SHALL APPLY REGARDLESS OF WHETHER THE DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT, OR ANY OTHER LEGAL THEORY OR FORM OF ACTION.

NOTWITHSTANDING THE FOREGOING, IF WE ARE FOUND TO BE LIABLE, OUR LIABILITY TO YOU OR TO ANY THIRD PARTY IS LIMITED TO THE GREATER OF THE TOTAL FEES YOU PAID TO US IN THE THIRTY (30) DAYS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY, OR $100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATION MAY NOT APPLY TO YOU.


24 Indemnity

You agree to defend, indemnify and hold harmless CMT, and its affiliates, officers, shareholders, owners employees, agents, partners and licensors, from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party with respect to any transaction(s) you are involved in with other users of the services; due to or arising from your access to, use of, or inability to use the services, your violation of these TOS, your breach of any of the representations and warranties herein; or the infringement by you or any other user of your account of any intellectual property or other right of any person or entity.


25 Dispute Resolution and Governing Law.

a. Informal Negotiations. To expedite resolution and control the cost of any dispute, controversy or claim related to these TOS and the transactions contemplated by these TOS (“Dispute’’), you and CMT agree to first attempt to negotiate any Dispute (except those Disputes expressly excluded below) informally for at least thirty (30) days before initiating any arbitration or court proceeding. Such informal negotiations commence upon written notice from one person to the other. CMT will send its notice to the email address you have provided to us. You will send your notice to support@camtastic.org

b. Binding Arbitration. If you and CMT are unable to resolve a Dispute through informal negotiations, either you or CMT may elect to have the Dispute (except those Disputes expressly excluded below) finally and exclusively resolved by binding arbitration. Any election to arbitrate by one party shall be final and binding on the other. YOU UNDERSTAND THAT ABSENT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN A COURT OF LAW. The arbitration will be conducted in Tel-Aviv by an arbitrator who will be appointed by the Head of the Israeli Bar.. The arbitration may be conducted in person, through the submission of documents, by phone or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by a party. The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except as otherwise provided in this Agreement, you and CMT may litigate in court to compel arbitration, stay proceeding pending arbitration, or to confirm, modify, vacate or enter judgment on the award entered by the arbitrator.

c. Restrictions. You and CMT agree that any arbitration shall be limited to the Dispute between CMT and you individually. To the full extent permitted by law, (i) no arbitration shall be joined with any other; (ii) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (iii) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

d. Exceptions to Informal Negotiations and Arbitration. You and CMT agree that the following Disputes are not subject to the above provisions concerning informal negotiations and binding arbitration: (i) any Disputes seeking to enforce or protect, or concerning the validity of any intellectual property rights; (ii) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy or unauthorized use; and (iii) any claim for injunctive relief.

e. Location. Any arbitration will take place at any reasonable location with the City of Tel-Aviv Israel. Any dispute to arbitration (other than claims proceeding in any small claims court), or where no election to arbitrate has been made, shall be decided by a court of competent jurisdiction within the city of Tel-Aviv Israel, and you and CMT agree to submit to the personal jurisdiction of that court.

f. Forum Non-Convenient. With regard to any Dispute not subject to arbitration, or where no election to arbitrate been made, you and CMT waive, to the fullest extent permitted by law, (i) any objection had now or latter, to the laying of venue of any legal action or proceeding arising out of or relating to this agreement brought in any court of the state of Israel sitting in Tel-Aviv, and (ii) any claim that any such action or proceeding brought in any such court has been brought in an inconvenient forum.

h. Governing Law. The services are controlled and operated by CMT from its offices in Eilat, Israel. CMT makes no representation that the services are available or appropriate for use in other locations. Your use of access to the services should not be construed as CMT purposefully availing itself of the benefits or privilege of doing business in any state or Jurisdiction other than Israel. except as expressly provided otherwise, the Laws of the state of Israel, without giving effect to its conflicts of law principals govern all matters arising out of or relating to this Agreement and all of the transactions it contemplates, including, without Limitation its validity, interpretation, construction, performance, and enforcement. Those who Choose to access the Services from locations outside of Israel, do so on their own initiative, and are responsible for compliance with local laws if and to the extent local laws are applicable.

i. Severability. You and CMT agree that if any portion of these TOS section is found illegal or unenforceable (except any portion of section (d)), that portion shall be severed and the remainder of the Section shall be given full force and effect. if Section (d) is found to be illegal or unenforceable then neither you nor CMT will elect to arbitrate any Dispute falling within that portion of section (d) found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the City of Tel-Aviv, State of Israel, and you and CMT agree to submit to the personal jurisdiction of that court.

26 Force Majeure.
Excluding payment obligations, neither party will be liable for delay default in the Performance of its obligations under this Agreement if such delay or default is caused by Conditions beyond its reasonable control, including but not limited to, fire, flood, storm accident, earthquakes, acts of God, labor disputes, telecommunications line failures, electrical Outages, network failures, denial-of-service attacks, riots, insurrection, explosions, acts of God, war, terrorism, or governmental action(each a "Force-majeure Event"). In the event that CMT suffers such a delay or default, CMT will excused from any further performance of its obligations effected by the Force Majeure Event for so long as the event continues.

27 No Agency.
No agency, agent, affiliate, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.

28 No Third Party Beneficiaries.
This Agreement does not and is not intended to confer any rights or remedies upon any person other than the parties, or be for the benefit of any third party. This Agreement is not enforceable by any third party, and will not confer on any third party and remedy, claim, right of action or other right.

29 Modifications to Services.
CMT may, in its sole discretion and without prior notice modify the Services and terms of privacy, and discontinue the Services at any time.

30 Assignment and Delegation.
YOU may not delegate any of your duties or assign any of your rights under this Agreement voluntarily or involuntarily, whether by merger, consolidation, dissolution, operation of law or any other manner. CMT may assign any of its rights and of its obligations under this Agreement without consent, including limitation, in connection with a corporate reorganization, consolidation, merger or sale of substantially all of its assets. Any purported Assignment of right or delegation of duties in violation of this Section is void.

31 Successors and Assigns.
This Agreement is binding upon registration to the benefit of the Parties and their respective permitted successors and assigns. This Section does not address, directly or indirectly, whether a party may assign its rights or delegate its duties under this Agreement.

32 Notice.
Unless otherwise specified herein, any notice or other communication to be given hereunder will be in writing and given by CMT via email to the address that you provide at registration Or by a posting on the CMT website; and by you via email to support@camtastic.org. The date of transmission will be deemed as the date on which such notice is transmitted.

33 Other.
The TOS constitute the entire agreement between you and CMT and govern your use of the CMT Services, superseding any prior agreements (whether written or oral) between you and CMT regarding the subject matter herein. Inaction or failure by CMT to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. if any provision of this Agreement is held void, invalid, illegal or unenforceable, the legality and enforceability of the remaining provisions of this Agreements are not affected or impaired in any way. The descriptive headings of the articles, sections, and subsections of this Agreement are for convenience only and not constitute a part of this Agreement.
